Governor Charlie Baker of Massachusetts is proposing a so-called "fair share contribution" requirement in his 2018 Budget Proposal in an effort to encourage employers to provide health coverage to their employees.
Many will recall that part of the Massachusetts health care reform law enacted in 2006 contained a fair share contribution requirement. The law required employers sponsoring insured or self- funded group coverage to either meet a 25% coverage standard, or make a fair share contribution toward health coverage of at least 33% of the premium cost of the group health coverage. This portion of the law was repealed as a result of the Affordable Care Act.
